1. General Information
These terms govern the use of the Bnude Art website (bnudeart.com) and marketplace, operated by Andersen Audio Productions SL (hereinafter, "the Gallery"). By placing an order, you agree to these terms.
2. Products and Purchases

Description: We sell original artworks, premium catalogs, limited edition prints, and other derived products. All items are sold as seen. While we strive for accuracy, colors may vary slightly due to screen settings.

Pricing: All prices are listed in Euros (€) and are exclusive of applicable taxes and shipping costs. For customers with a shipping address within Spain, the applicable Value Added Tax (VAT) will be clearly added to the artwork price during checkout. For all other international orders, the price displayed is the net price of the artwork. Import duties, taxes (such as VAT, GST, or HST), and customs clearance fees are the sole responsibility of the recipient. These charges are levied by the customer's local customs authority upon arrival of the shipment, and we have no control over their calculation. We recommend contacting your local customs office for information on potential costs before placing an order.

Order Process: Placing an item in your cart does not reserve it. A binding contract for the purchase of the artwork is formed when we send you an order confirmation email, following your successful payment for the item. However, the artwork will not be shipped without the explicit acceptance and payment of the bespoke shipping quote we provide. The artwork will be reserved for you for 30 days and will only be shipped after both the artwork payment and the approved shipping fee have been received in full.

Payment: Accepted methods: Credit/Debit Card (via Stripe/Redsys), Bank Transfer, Transferwise.
3. Shipping, Delivery, and Returns

Shipping: Handled by specialized art shippers.
Due to the unique nature of each artwork, we cannot calculate standard shipping fees. Therefore, our checkout process involves two separate and distinct payments:-
Artwork Payment: You pay for the selected artwork(s) at checkout.

Shipping Quotation & Payment: Within 48 business hours of your order, we will engage our specialist art shipping partner to prepare a bespoke quote. This quote will include all costs for professional packing, insurance, and secure transportation to your address. We will email you this detailed quote for your review. You may then:

Accept the quote, at which point we will send a secure payment link for the shipping amount.

Decline the quote, at which point you are entitled to a full refund of your artwork payment, and the contract will be dissolved.

The artwork will only be dispatched after the shipping fee has been paid. Delivery timelines will be provided with your quote.

For order cancellations prior to shipment (including refusal of shipping quote): Refunds will be issued to the original payment method, minus any non-recoverable transaction fees (such as payment gateway processing fees) incurred by the Gallery.

Risk and Title: Risk of loss/damage passes to you upon delivery. Title passes upon full payment.

Returns for Damages: You must inspect the artwork upon delivery and notify us of any damage within 48 hours to initiate a claim.

Right of Withdrawal (EU Consumers): You have the legal right to withdraw from the contract within 14 calendar days of receiving the artwork, excluding custom or commissioned pieces. If you exercise this right, you will receive a full refund of the artwork price paid. Return shipping costs, as well as the cost of the original bespoke shipping, are the customer's responsibility. The artwork must be returned in its original, perfect condition.
4. Intellectual Property
All intellectual property rights (copyright, trademarks) on the website and the artworks remain with the Gallery or the respective artists. Purchasing an artwork does not transfer the copyright. You may not reproduce or commercially exploit images of purchased artworks without permission.
5. Limitation of Liability
The Gallery's liability is limited to the value of the order. We are not liable for indirect or consequential losses.
6. Governing Law and Jurisdiction
These terms are governed by Spanish law. For any disputes, the courts of Rubí, Spain, shall have jurisdiction.
